What is the penalty for driving without a motorcycle license

The Wisconsin Department of Transportation informs us that 36% of motorcycle fatalities within the last ten years involved a rider that did not have a valid motorcycle license. In some of those years, the percentage was up to nearly half! The Wisconsin Motorcycle Safety Program manager agrees that unlicensed motorcycle riders are a huge concern.

In Wisconsin, riding without a license risks three demerit points along with a fine of $200. Last year, over 850 people were successfully prosecuted for just that, although the issue continues to persist. To encourage change, some states have adopted even harsher traffic law penalties for motorcycle drivers, such as impoundment of the motorcycle. However, time has shown that these punishments have not made a difference in the number of citations given for the issue.

The license required in order to drive a motorcycle belongs to Class M, or at minimum, the corresponding learner’s permit and training course. The fee for an instruction permit is currently $32, and the fee for a Class M license is $22, although there may be changes to these prices. Keep in mind that the rules for a moped or scooter are not the same as that of an actual motorcycle. Specific requirements like motorcycle operator skills tests or knowledge tests, for obtaining a motorcycle license, or any other type of valid driver’s license, can easily be found online or from your local DMV.

Driving a motorcycle is considered more difficult than driving a regular four-wheeled car or motor vehicle. In addition, a bike rider is at a much greater risk of being harmed without a vehicle surrounding their body for protection. This is why we urge anyone that wants to start driving a motorcycle to obtain the necessary license and motorcycle insurance. This simple action is required by law for your protection as well as the others on the road around you.

Not wearing a helmet, driving without a licence or without insurance are the most common reasons for which you can be fined. But there are others that you may not be aware of.

Traffic rules are necessary to reduce all types of accidents. Do you know what the most common fines for motorcyclists in Spain are?

  • Driving a motorbike without having passed the specific training: 200 euros.
  • Driving without the vehicle having insurance in force to cover compulsory civil liability: between 650 euros and 1,250 euros.
  • Failure to wear an approved protective helmet: 200 euros and 3 points deducted from the driving licence. If the person not wearing the helmet is the passenger on the motorbike, no points will be deducted.
  • Driving with free exhaust and no blast silencer fitted or with an ineffective silencer: 200 euros.
  • Driving with children under 12 years of age as passengers (except for children over 7 years of age if the driver is their parent or guardian): 200 euros.
  • Failure to ride on the right-hand side of the road when pushing or pulling a motorbike: 80 euros.
  • Driving without having your driving licence on you: 10 euros, if it is out of date or if there is any incorrect information (including the postal address), 80 euros. So remember to renew your driving licence. In addition, if you drive a motorbike with a licence that does not entitle you to do so, the fine is 500 euros and 4 points on your licence.
  • Failure to obey a sign prohibiting entry for motorbikes, 80 euros.

In addition, in urban areas there are fines that may vary depending on the municipality. For example, if you park obstructing a pedestrian crossing, the fine is 200 euros. The same amount is payable if you park on a pavement that is no more than 3.5 metres wide. And remember not to do wheelies or skidding as the fine is 100 euros.

The best way to avoid all these penalties is to always respect the rules, to drive safely for your own sake and for the sake of those around you.

motorbike solicitor has produced a series of Offence Guides geared at helping motorcycle riders and their pillion passengers understand common road traffic offences and the issues facing them should they be stopped by the police.

This page contains our guide to the offences of driving otherwise than in accordance with a licence and driving with no road tax.

Driving otherwise than in accordance with a licence

It is an offence to drive a motorbike on the road for which you do not have an appropriate driving licence for – whether you are driving without a licence at all; do not have the relevant licence for that class of vehicle; are driving during a period of disqualification; are on a provisional licence without displaying ‘L’ plates and/or are driving in the UK on an invalid foreign licence (generally or for the motorbike).

Causing or permitting someone to drive without a licence is also an offence – for instance, allowing someone to use your motorbike when they do not possess a valid driving licence.

If the authorities show that the vehicle was being driven on the road it is your responsibility to show that a valid licence applied at that time.

Remember, if a motorbike is being ridden without a valid licence this will more than likely invalidate any insurance policy held by the driver, so the charge of driving without insurance may apply.

This offence carries fines up to £1000, 3-6 penalty points and discretionary disqualification from driving.

Your defence must show that the person driving held a valid licence, or place doubt that the motorbike in concern was being driven on a road or was being driven at all.

Relevant facts must be identified if a reduced punishment or acquittal is to be obtained. If the circumstances were those of genuine emergency, the court may also take this into account.

  • Driving with no road tax – up to £1,000 or 5 times the annual road tax fee (whichever is greater). Paying back duty may also apply.

  • Using a motorbike declared SORN – up to £2,500 fine

Possible defences may be that you were not the keeper of the motorbike; the bike was stolen; it was not being used on a public road or you were within the ‘period of grace’ following the expiry of your road tax.
